GENERAL WAIVER OF LIABILITY: I (Participant named below) hereby release, indemnify, and hold harmless, Idaho Horsemen, Lady Spurs, staff (Platinum Events & Security LLC.) (Company), its owners, members, advisors, and all employees and agents of these parties from all liabilities, suits, claims and/or demands of any kind or nature, legal or financial, whether caused in any way by the negligence or not, arising from the participation in or observation of any Company activity for injuries to any person or property, whether on or off the premises. The undersigned participant voluntarily engages in all activities of the Company, acknowledging that participation entails inherent risks associated with both formal and informal Company activities. These activities include but are not limited to on or off field activities and other physically strenuous exercise and related workouts and performances. I agree to assume full responsibility for and risks, injuries, or damages that might occur because of participating in activities sponsored by the Company. The Company is not responsible for any lost or stolen property, at any time.
MEDICAL RELEASE: I, the undersigned, authorize The Company and its designated representatives to admit me to any hospital or medical facility for diagnosis and treatment. I also authorize licensed physicians, dentists, and medical staff to perform any necessary diagnostic, treatment, or operative procedures, including x-ray treatments. I understand that no guarantees have been made regarding the results of any examination or treatment. I hereby authorize The Company, its owners, members, employees, and agents to act on behalf of the Participant, using their best judgment to provide or arrange for emergency care in any situation requiring medical attention.
USE OF LIKELINESS/PHOTO RELEASE: I grant to The Company the irrevocable right and permission to film, videotape, photograph and/or otherwise record you and to reproduce, publish, distribute, display, broadcast, exhibit, and/or in any other way use your image, likeness, signature, voice, photograph, name (including nicknames), actual and/or paraphrased statements, biographical information and/or any other information or attribute identifying and/or otherwise associated with the Idaho Horsemen (collectively, “Likeness”), in whole or in part, distorted, altered, modified and/or adapted in character and/or in form, alone and/or accompanied by other material, in any manner and without restriction of any kind, worldwide, in perpetuity and royalty-free, for any purpose whatsoever, including without limitation for the purpose of advertising, publicity, promotion, and/or other marketing for the Idaho Horsemen and/or The Lady Spurs, in all media now known or hereafter developed (including without limitation in social media) without compensation to me or the Participant named below. I understand and agree that such photographs and/or video recordings may be placed on the Internet. I also understand I may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings. I waive the right to approve the final product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of the Company.
I hereby release, acquit and forever discharge the Company., its current and former trustees, agents, officers and employees of the above-named entities from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.
IN CONSIDERATION OF MUTUAL BENEFIT: I undersigned, both collectively and individually, irrevocably release, discharge, and absolve The Company from any and all claims, actions, lawsuits, demands, agreements, obligations, judgments, and legal proceedings, both in law and in equity, that have arisen up to the date of this document.
This release is legally binding and will benefit both parties, including their successors, assigns, and legal representatives.
I affirm that I am at least eighteen (18) years of age and have the legal capacity to enter into contracts in my own name. This release is legally binding upon myself, my heirs, assigns, and legal representatives.
